In Guatemala, there is the SECRETARY AGAINST SEXUAL VIOLENCE, EXPLOITATION AND TRAFFICKING IN PERSONS, of whom we share the following information:

LEGISLATION ON TRAFFICKING IN PERSONS

TRAFFICKING IN PERSONS AS ESTABLISHED IN THE LAW AGAINST SEXUAL VIOLENCE, EXPLOITATION AND TRAFFICKING IN PERSONS

In accordance with Article 47 of the Law Against Sexual Violence, Exploitation and Trafficking in Persons, which adds Article Ter to the Penal Code, Decree Number 17-73 of the Congress of the Republic, which is as follows: 

“Article 202 Ter. It’s about people. It constitutes a crime of trafficking in persons the recruitment, transport, basting, retention, reception or reception of one or more persons for the purpose of exploitation ”. Whoever commits this crime will be sanctioned with prison of eight to eighteen years and a fine of three hundred thousand to five hundred thousand quetzales. In no case will the consent given by the victim of trafficking in persons or by their legal representative be taken into account. 

For the purposes of the crime of trafficking in persons, the purpose of exploitation shall be understood as: 

The prostitution of others, any other form of sexual exploitation, forced labor or services, any type of labor exploitation, begging, any form of slavery, servitude, the sale of people, the extraction and trafficking of human organs and tissues, recruitment of minors for organized criminal groups, irregular adoption, irregular adoption process, pornography, pregnancy forced or forced or servile marriage.
